Use beyond the agreed scope is not permitted.\u003c\/p\u003e\n\u003ch4\u003e\u003cstrong\u003e§2 Services of the provider\u003c\/strong\u003e\u003c\/h4\u003e\n\u003cp\u003e(1) The provider undertakes to provide the user with access to the software as well as the necessary instructions and support services.\u003cbr\u003e(2) The provision includes:\u003c\/p\u003e\n\u003cul\u003e\n\u003cli\u003eAccess data for the software\u003c\/li\u003e\n\u003cli\u003eInstruction on how to use the software\u003c\/li\u003e\n\u003cli\u003eUpdates and technical adjustments in accordance with legal requirements\u003c\/li\u003e\n\u003c\/ul\u003e\n\u003cp\u003e(3) Ensuring compliant data transfer to the tax office in accordance with RKSV (Cash Register Security Ordinance) is included. \u003cbr\u003e\u003c\/p\u003e\n\u003ch4\u003e\u003cstrong\u003e§3 Obligations of the user\u003c\/strong\u003e\u003c\/h4\u003e\n\u003cp\u003e(1) The user undertakes to use the software in accordance with the legal requirements and to install updates regularly.\u003cbr\u003e(2) The user is solely responsible for entering the data correctly and complying with legal requirements, in particular the RKSV.\u003cbr\u003e(3) Passing on the software or access data to third parties is prohibited.\u003cstrong\u003e\u003c\/strong\u003e\u003c\/p\u003e\n\u003cp\u003e(4) The user is advised that the use of the cash register software does not include the complete issuance of a tax-compliant invoice within the meaning of the Austrian UStG regulations. It is the user's responsibility to issue a proper invoice for each business transaction.\u003c\/p\u003e\n\u003cp\u003e(5) To support this process, the provider recommends using the \u003cstrong\u003eInvoice automation\u003c\/strong\u003e by his partner \u003cstrong\u003eFastbill\u003c\/strong\u003e (\u003ca href=\"http:\/\/www.fastbill.com\" rel=\"noopener\" data-mce-href=\"http:\/\/www.fastbill.com\" target=\"_new\"\u003e\u003cspan\u003ewww.fastbill.com\u003c\/span\u003e\u003c\/a\u003e\/ Fastbill Pro is required to use the API interface). This solution makes it possible to automatically create invoices in an individual design and send them directly to customers via the user's own email address. If you are interested, the provider will provide the integration and setup of the automation solution.\u003c\/p\u003e\n\u003ch3\u003e\u003cstrong\u003e§4 Fees, payment conditions and payment modalities\u003c\/strong\u003e\u003c\/h3\u003e\n\u003cp\u003e(1) For the use of the software, the user pays a monthly fee of: \u003cstrong\u003e[Amount] EUR\u003c\/strong\u003e plus statutory VAT. Payment is made to the provider's account by the 5th working day of each month.\u003c\/p\u003e\n\u003cp\u003e(2) The provider undertakes to process all transactions received within at the latest \u003cstrong\u003e5 working days\u003c\/strong\u003e to be paid out to the user after successful processing. A share of the transaction amounts will be: \u003cstrong\u003e15%\u003c\/strong\u003e the \u003cstrong\u003eDigital Partner Suite Costs\u003c\/strong\u003e retained as a service fee per transaction.\u003c\/p\u003e\n\u003cp\u003e(3) The service fee covers services such as software maintenance, technical infrastructure and support. A detailed statement of transactions and retained fees is provided to the user on a monthly basis.\u003c\/p\u003e\n\u003cp\u003e(4) The payment is made to the business account stored by the user. The user is responsible for providing current and correct account details to avoid delays in withdrawals.\u003c\/p\u003e\n\u003ch4\u003e\u003cstrong\u003e§5 Liability and warranty\u003c\/strong\u003e\u003c\/h4\u003e\n\u003cp\u003e(1) The provider assumes no liability for damages resulting from improper use of the software by the user.\u003cbr\u003e(2) The provider guarantees compliance with legal requirements within the scope of the software functionality, but is not liable for legal changes that require adjustments.\u003cbr\u003e(3) In the event of failures or malfunctions in the software, the provider undertakes to remedy these within a reasonable period of time.\u003c\/p\u003e\n\u003ch4\u003e\u003cstrong\u003e§6 Contract duration and termination\u003c\/strong\u003e\u003c\/h4\u003e\n\u003cp\u003e(1) The contract is concluded for an indefinite period of time.\u003cbr\u003e(2) Both parties can terminate the contract with a notice period of \u003cstrong\u003e3 months\u003c\/strong\u003e cancel at the end of the month. There is a minimum commitment period of 12 months upon registration.\u003cbr\u003e(3) Extraordinary termination is possible in the event of a serious breach of contract.\u003c\/p\u003e\n\u003ch4\u003e\u003cstrong\u003e§7 Data protection and confidentiality\u003c\/strong\u003e\u003c\/h4\u003e\n\u003cp\u003e(1) The provider undertakes to use all data collected or processed during the use of the software exclusively to fulfill the contractually agreed services and not to use them beyond that.\u003c\/p\u003e\n\u003cp\u003e(2) Personal data, in particular those related to the user's or their customers' business transactions, are treated as strictly confidential and only processed to the extent necessary to ensure the software functionality and to fulfill legal obligations.\u003c\/p\u003e\n\u003cp\u003e(3) A transfer of this data to third parties or processing for other purposes is excluded unless the user has given express written consent or the processing is absolutely necessary due to legal regulations.\u003c\/p\u003e\n\u003cp\u003e(4) The provider will take appropriate technical and organizational measures to ensure the confidentiality, integrity and availability of the data\u003c\/p\u003e\n\u003ch3\u003e\u003cstrong\u003e§8 Use of ATM and credit card information\u003c\/strong\u003e\u003c\/h3\u003e\n\u003cp\u003e(1) The software supports payments via \u003cstrong\u003eMastercard debit, Mastercard credit cards\u003c\/strong\u003e as well as \u003cstrong\u003eVisa credit cards\u003c\/strong\u003e. The provider recommends entering data exclusively via the secure input masks provided in the software.\u003c\/p\u003e\n\u003cp\u003e(3) If necessary, the user is permitted to assist the customer in entering the card details. It must be ensured that the data is treated confidentially and that no unauthorized third parties have access to it. Storing the card data outside of the software is not permitted.\u003c\/p\u003e\n\u003cp\u003e(4) The user undertakes to take all measures to ensure the security of payment data in accordance with applicable standards (e.g. PCI DSS).
